When you are named as a beneficiary of a living trust you have certain rights to protect your interests. The duties of the trustee (the person who manages and distributes trust assets) include making sure that the beneficiaries are involved in the trust processes.
Beneficiary rights in California include:
• Notice of trust information and contents
• Annual accounting of trust assets, distributions and expenses
• Right to challenge in court the legal sufficiency of the trust
Sometimes the trustee will also be one of the beneficiaries of a trust, and the other beneficiaries have a right to question or challenge their actions or decisions that impact the trust assets or distributions.
